These Terms of Service govern access to and use of the website https://betenoir.com (the “Site”).

The Site is published by ROCNE, a simplified joint-stock company (société par actions simplifiée, SAS) with share capital of 3 000 euros, whose registered office is located at 20 quai de la Mégisserie, 75001 Paris, France, registered with the Paris Trade and Companies Register (Registre du commerce et des sociétés) under number 131 298 176, intra-Community VAT number FR44131298176, operating the BETENOIR brand.

By accessing or using the Site, you accept these Terms of Service.

1. Purpose of the Site

The Site presents the universe, products and activities of BETENOIR and, where applicable, allows the online purchase of products marketed by ROCNE.

Sales made on the Site are governed by our Terms of Sale, our Shipping policy and our Refund policy.

2. Access to the Site

ROCNE endeavours to ensure the accessibility and proper functioning of the Site.

Access to the Site may, however, be temporarily suspended, restricted or interrupted, in particular for reasons of maintenance, security, updates or technical incidents, or in the event of force majeure.

ROCNE does not guarantee that the Site will be accessible at all times or that it will be completely free of errors, viruses or other elements liable to affect the user’s equipment or data.

3. Permitted use

The user undertakes to use the Site fairly, lawfully and in accordance with its intended purpose.

It is prohibited, in particular:

to use the Site for fraudulent or unlawful purposes;
to attempt to gain unauthorised access to the Site, its systems or its data;
to disrupt or compromise the operation or security of the Site;
to introduce viruses, malware or harmful code;
to automatically collect or extract the content or data of the Site without authorisation;
to use the Site or its content in a manner liable to infringe the rights of ROCNE, BETENOIR or third parties.

ROCNE may suspend or restrict access to the Site in the event of abusive use or use contrary to these Terms.

4. Customer account

Certain features may require the creation of a customer account.

The user undertakes to provide accurate, complete and up-to-date information. The user is responsible for the confidentiality of their login credentials and for the actions carried out from their account.

Any unauthorised use or suspected compromise must be reported without delay to contact@betenoir.com.

ROCNE reserves the right to suspend or delete an account in the event of fraud, abusive use or breach of these Terms, without prejudice to the consumer’s rights relating to orders already concluded.

5. Intellectual property

The Site and all of its elements, in particular the trademarks, trade names, logos, texts, photographs, videos, illustrations, graphic creations, sound elements, databases, software, product presentations and editorial content, are protected by intellectual property rights.

Except with the prior written authorisation of ROCNE, any reproduction, display, adaptation, modification, distribution, extraction or exploitation, in whole or in part, is prohibited, with the exception of strictly private uses permitted by law.

The BETENOIR brand and the associated distinctive signs may not be used without prior authorisation.

The BETENOIR brand was created by the company XIONS GROUP, which is its proprietor. ROCNE operates it under the rights granted to it by XIONS GROUP.

6. Product information

ROCNE takes the greatest care in presenting the products and in ensuring the accuracy of the information published on the Site.

Photographs, colours and visual representations are provided for illustrative purposes. Their rendering may vary depending on the screen or device used.

The conditions applicable to sale, prices, payments, availability, delivery, returns and guarantees are set out in the Terms of Sale.

7. Reviews and content posted by users

Where the Site allows a review, comment, photograph or any other content to be posted, the user warrants that this content:

is accurate and based on real experience;
does not infringe the rights of third parties;
contains no unlawful, defamatory, discriminatory, threatening or obscene statements;
contains no unauthorised advertising or misleading information.

ROCNE reserves the right to moderate or remove any content that is manifestly unlawful or contrary to these Terms.

By posting content on the Site, the user authorises ROCNE, free of charge and on a non-exclusive basis, to reproduce and display it solely for the purposes of operating, presenting and promoting the Site and the products concerned, in compliance with the applicable regulations.

ROCNE has no control over these sites and cannot be held liable for their content, their availability, their commercial practices or their processing of personal data.

The Site uses cookies and other trackers under the conditions set out in our Cookie policy.

ROCNE cannot be held liable for damage resulting from use of the Site that does not comply with these Terms, from a fault of the user, from an unforeseeable and insurmountable act of a third party, or from an event of force majeure.

ROCNE may amend these Terms in order to take account of changes to the Site, its services or the regulations.

12. Governing law

These Terms of Service are governed by French law.

In the event of a dispute, the parties will first seek an amicable solution. Failing that, the dispute will be submitted to the competent courts in accordance with the applicable legal rules.
