2. Scope
These Terms of Sale govern sales of products concluded on the Site between BETENOIR and any natural person acting as a consumer.
They are provided to the customer before the order is confirmed. The customer acknowledges having read and accepted them by confirming their order.
3. Products
The essential characteristics of the products are presented on the corresponding pages of the Site.
Photographs, graphic representations and descriptions are provided with the greatest care. Slight differences in colour, appearance or presentation may exist, in particular due to screen settings or minor changes in packaging.
The products are offered subject to available stock.
4. Prices
Prices are stated in euros, inclusive of all taxes, excluding delivery costs.
The amount of the delivery costs and the total price of the order are communicated to the customer before the final confirmation of the order.
BETENOIR may change its prices at any time. Products are invoiced at the price displayed at the time the order is confirmed.
For deliveries outside the European Union, customs duties or import taxes may be charged to the recipient under the conditions set out in the Shipping policy.
5. Orders
Before confirming their order, the customer may check its contents, its total price and their address, and correct any errors.
Final confirmation by means of the button clearly indicating the obligation to pay constitutes acceptance of the order and of these Terms of Sale.
A confirmation is then sent to the customer by email.
BETENOIR reserves the right to suspend or cancel an order in the event of:
-
refusal of payment;
-
manifestly incorrect or incomplete information;
-
reasonable suspicion of fraud;
-
unavailability of the product;
-
a prior dispute relating to the payment of an order.
In the event of cancellation after payment, the sums collected will be refunded.
6. Payment
Payment may be made by means of the payment methods offered when the order is placed.
Payment is processed by secure payment providers. BETENOIR does not have access to the customer’s full banking details.
The products remain the property of BETENOIR until the price has been paid in full.
7. Availability
If a product is unavailable after the order has been placed, the customer will be informed as soon as possible.
The customer may obtain a refund for the unavailable product or, with their agreement, choose another product.
8. Delivery
Delivery areas, methods, costs and lead times are set out in the Shipping policy and at the time of the order.
The risk of loss of or damage to the products is transferred to the consumer when the consumer, or a third party designated by the consumer other than the carrier proposed by BETENOIR, takes physical possession of the products.
9. Right of withdrawal
The consumer has a period of 14 calendar days from receipt of the products to exercise their right of withdrawal.
The procedures for exercising this right, returning products and obtaining a refund are set out in the Refund policy, which forms an integral part of these Terms of Sale.
10. Statutory guarantees
The consumer benefits from the statutory guarantee of conformity provided for by the French Consumer Code (Code de la consommation) as well as from the guarantee against hidden defects provided for by Articles 1641 et seq. of the French Civil Code (Code civil).
Under the statutory guarantee of conformity, the consumer has a period of two years from delivery of the goods in which to take action.
The consumer may request that the goods be brought into conformity by repair or replacement, subject to the cost conditions provided for by law. Where repair or replacement is impossible, does not take place within a reasonable time or causes major inconvenience, the consumer may benefit from a price reduction or from termination of the contract under the conditions provided by law.
The statutory guarantee of conformity applies independently of any commercial guarantee that may be granted.
Under the guarantee against hidden defects, the consumer may choose between rescission of the sale or a price reduction, in accordance with Article 1644 of the French Civil Code.
11. Liability
BETENOIR is responsible for the proper performance of its contractual obligations under the conditions provided for by law.
The liability of BETENOIR may not be engaged in the event of non-performance resulting from an unforeseeable and insurmountable act of a third party, a fault of the customer or a force majeure event.
Nothing in these Terms of Sale limits the mandatory rights granted to the consumer.
12. Intellectual property
All elements of the Site and of the BETENOIR universe are protected by intellectual property rights.
Any unauthorised reproduction or exploitation, in whole or in part, is prohibited.

Personal data is processed in accordance with our Privacy policy.

16. Governing law and disputes
These Terms of Sale are governed by French law.
In the event of a dispute, an amicable solution will be sought as a priority.
Failing agreement, the consumer may bring the matter before the territorially competent court in accordance with the rules of ordinary law. The mandatory rights enjoyed by a consumer residing in another country are not affected.
17. Amendment and archiving
